The petitioner apprehends his arrest in Sugauli P.S. Case No. 188 of 2016 instituted for the offence under Section(s) 420, 467, 468, 471 of the Indian Penal Code. It is alleged that petitioner got appointment in the Postal Department as a Postman on 21.07.2011 on the basis of forged mark-sheet issued by the Bihar Sanskrit Shiksha Board, Patna.

It has been submitted that the petitioner has already resigned from the said post on 11.05.2015. A statement to that effect has also been mentioned in para 7 of the present application.

No.6054 of 2017 (2) dt.17-02-2017 2/2 From the written report, it appears that the instant case has been filed on 02.09.2016, wherein it has been mentioned that petitioner got appointed on 21.07.2011. Considering the inordinate delay in lodging the present case and fact that petitioner has already resigned from the aforesaid post, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Sugauli P.S. Case No. 188 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
