This is a petition for grant of regular bail in a case registered for offences punishable under Sections 399, 402, 353 and 307 of the Indian Penal Code and Sections 25 (1-b)a, 26, 27 and 35 of the Arms Act.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that the petitioner was not apprehended on the spot and nothing incriminating articles has been recovered from the possession of the petitioner. It is further submitted that neither offence under Section 307 of the Indian Penal Code nor under Section 25 (1-b) a, 26, 27 and 35 of Arms Act is made out against the petitioner and the petitioner is in

Patna High Court Cr.Misc. No.1382 of 2017 (3) dt.09-03-2017 2/2 custody since 17.09.2016.

Considering the facts and circumstances, let the above named petitioner, Chhotu Singh is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Khagaria in connection with Pasraha P. S. Case No. 118 of 2016.
