The petitioner seeks bail in anticipation of his arrest in connection with Sanokhar (Amdanda) P.S. Case No. 153 of 2018 dated 13.10.2018 instituted for the offences under Sections 406, 408, 409, 420 and 120(B) of the Indian Penal Code.

It has been submitted that the subject FIR has been lodged on the direction of a Public Grievance Redressal Cell. Six allegations have, in all, been alleged against the accused persons including the petitioner, who

Patna High Court CR. MISC. No.19250 of 2019(2) dt.02-04-2019 2/3 at the relevant time, served as the Panchayat Secretary. Some of the allegations are pertaining to the year during which the petitioner was not posted in the aforesaid Panchayat as Panchayat Secretary. The other allegations which could be attributed to the petitioner are in the nature of expending more than what was authorized. It has been categorically stated by the learned counsel for the petitioner that there is no allegation of any embezzlement of funds but only expenses which were not in accordance with the manifest.

Considering this aspect of the matter, the Mukhiya of the Gram Panchayat has been granted anticipatory bail by a bench of this Court by order dated 14.03.2019 passed in Cr. Misc. No. 15894 of 2019. Regard being had to the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in

No.19250 of 2019(2) dt.02-04-2019 3/3 the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Sanokhar (Amdanda) P.S. Case No. 153 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
