The petitioner is apprehending her arrest in connection with Dighwara P.S. Case No. 201 of 2016 registered for the offences punishable under Sections 302, 379, 120B/34 of the Indian Penal Code and 27 of the Arms Act. It has been submitted on behalf of the petitioner that even according to FIR there is only suspicion raised against the petitioner and petitioner is a lady and even the informant is not an eye-witness to the occurrence and the main allegation is against Manu Singh, son of the petitioner.

Having heard both sides and considering the fact that petitioner is a lady and there is no specific allegation against her

Patna High Court Cr.Misc. No.9971 of 2017 (2) dt.18-03-2017 2/2 and only on the basis of suspicion she has been implicated, let the petitioner, above named, in the event of her arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Saran at Chapra, in connection with Dighwara P.S. Case No. 201 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall cooperate in the investigation and make herself available before the police as and when required and in the event of failure on her part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of her bail bonds and further petitioner will not induce any witness or tamper with the evidence.
