====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 05-04-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sessions Trial No. 141 of 2022 arising out of Beldaur P.S. Case No. 222 of 2021 corresponding to G.R. No. 3103 of 2021, dated 27.09.2021, lodged under Section 302 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel for the petitioner submits that bail application of petitioner was rejected vide order dated 01.09.2022 passed in Cr. Misc. No. 23301 of 2022 with an observation that petitioner may renew his prayer for bail after framing of charge.

Learned counsel for the petitioner submits that charge has already been framed in this case on 30.09.2022, which is

Patna High Court CR. MISC. No.21666 of 2023(2) dt.05-04-2023 2/2 annexed as Annexure-3 to this application.

Learned counsel for the State submits that from the record, it transpires that charge has already been framed. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Khagaria in connection with Sessions Trial No. 141 of 2022 arising out of Beldaur P.S. Case No. 222 of 2021 corresponding to G.R. No. 3103 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
