JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Dharhara P.S. Case No. 19 of 2011 registered for the offences punishable under Sections 406, 409, 467, 468, 471/34 of the Indian Penal Code.
Petitioner no. 1 was Assistant Engineer whereas petitioner no. 2 was Junior Engineer at the relevant time and their name came in this case in course of investigation. The informant made allegation against the Mukhia, Rozgar Sewak and Panchayat Secretary but petitioners were also made accused in the present case as they were engaged with the concerned schemes of the government. Moreover, one co-accused, Vivek Kumar, who happens to be Block Development Officer, has already been
Patna High Court Cr.Misc. No.25956 of 2013 (4) dt.24-03-2015 granted privilege of anticipatory bail by a co-ordinate Bench of this Court.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Munger in Dharhara P.S. Case No. 19 of 2011 subject to condition as laid down under Section 438(2) of the Cr.P.C.
