JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2019 This is an application for grant of anticipatory bail in connection with Kotwali (Jogsar) P.S. Case No.857 of 2018, disclosing offences under Sections 419, 420, 467, 468, 471, 354, 504, 34 of the Indian Penal Code.

Allegation as per written report filed by the informant is that she had an agreement with Kumar Prabhakar, Director of DPRO, Foundation for sale of a piece of land for Rs.4,00,000/- and on that, she gave a sum of Rs.1,00,000/- as an advance money, but in spite of agreement, he has not executed the sale deed of that land and when he made complaint about the same. Thereafter, he demanded Rs.3,50,000/- and further case is that on protest the above accused persons Kumar Prabhakar and his wife Sikha Kumari became aggressive and misbehaved with the informant.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Bhagalpur, in connection with Kotwali (Jogsar) P.S. Case No. 857 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
