JUSTICE BIRENDRA KUMAR ORAL ORDER 21-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code.
One person was apprehended with stolen motorcycle who disclosed the names of the petitioners. Submission of the petitioners is that besides confessional statement of co-accused there is no other material against the petitioners. Nothing was recovered from the possession of the petitioners nor they have got any criminal antecedent. Considering the aforesaid facts, let the petitioners,
Patna High Court Cr.Misc. No.8257 of 2017 (3) dt.21-04-2017 above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri R. Narayan, learned A.C.J.M.-III, Araria/Successor Court in connection with Palasi P.S. Case No.118 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and subject to the further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioners in this case.
