JUSTICE SANJAY PRIYA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504, 354(b) of the Indian Penal Code and Section 27 of the Arms Act.

It has been submitted that there is case and counter case. The occurrence took place on account of land dispute. There is general and omnibus allegation against the petitioner. Learned counsel for the petitioner has specifically stated that the allegation against the petitioner is of giving Farsa blow on the head of Nirmal Singh.

The injury report has been enclosed as Annexure-3

Patna High Court Cr.Misc. No.6005 of 2017 (2) dt.16-02-2017 2/2 wherein the doctor has found simple injury caused by hard and blunt substance. From the injury report it reveals that there is no repetition of blow.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Sasaram Town (Darigaon) P.S. Case No. 905 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
