JUSTICE SANJAY PRIYA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Buxar (I) P.S. Case No. 15 of 2017 instituted for the offence under Sections 419, 420 and 120(B) of the Indian Penal Code.

The allegation against the petitioner is that he obtained death certificate of his uncle Safat Khan showing his date of death as 26.11.2015. It is further alleged that Mumtaz Khan has obtained death certificate of his father showing date of death as 17.10.1980. Sairya Bibi wife of the deceased Safat Khan has obtained death certificate showing date of death of her husband as 15.9.1984. The informant is Panchayat Secretary. It has been submitted on behalf of the petitioner that no benefit has been derived from the aforesaid certificate. It has

It has further been submitted that Mumtaz Khan has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 24.3.2017 passed in Cr. Misc. 12398 of 2017.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today, in connection with Buxar (I) P.S. Case No. 15 of 2017, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
