Petitioner seeks bail in Suppi P.S. Case No.01 of 2020 registered under Sections 414, 272 and 273 of the IPC and under Section 30(a) of the Bihar Prohibition and Excise Act. The informant alleged that three persons were coming on motorcycles. Two persons were apprehended and one person managed to flee away. The apprehended persons disclosed the name of the petitioner as the person, who had managed to flee away. From the vehicle of the petitioner, 144 litres of liquor is said to have been recovered.

Learned counsel for the petitioner submits that nothing has been recovered from conscious possession of the petitioner. Both apprehended accused persons have already been enlarged on bail by a coordinate Bench of this court. The case of

Learned A.P.P. opposed the prayer for bail.

Having considered the facts that similarly situated two accused persons, who were apprehended on the spot, have been enlarged on bail, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned A.D.J. II-cum-Special Judge, Excise Act, Sitamarhi in connection with Suppi P.S. Case No.01 of 2020. (Prabhat Kumar Jha, J) Harish/- U T
