2. The present petition has been preferred for the grant of following relief(s):

"(i) to issue an appropriate order/s, direction/s including a writ in the nature of certiorari for quashing the order dated 3.8.2023 passed in Bataidari Appeal Case No. 25 of 2001 passed by the learned Additional Collector,

Patna High Court CWJC No.5798 of 2024(2) dt.07-04-2026 2/3 Sitamarhi (the prescribed appellate authority under the Bihar Tenancy Act 1885) passed under Section 48E of the Bihar Tenancy 1885 whereby and whereunder he has dismissed the appeal filed by the petitioner and affirmed the order dated 5.4.2001 passed by the learned Deputy Collector, Land Reforms, Sitamarhi Sadar.

(ii) to quash the order dated 5.4.2001 passed in (Bataidari Case No. 126 of 1992-93 under Section 48 (F) of the Bihar Tenancy Act 1885 whereby and whereunder he has dismissed the aforesaid Bataidari Case No. 126 of 199293. (iii) to direct the concern respondent to declare the petitioner Bataidar who has been threatened with unlawful ejectment from the tenancy with respect to a land measuring 75 dec., 65 dec., 47 dec., and 59 dec., total 2.46 decimal to Khesra No. 1263, 1524, 1525, 1526 Khata No. 109 situated in Mouza-Bhaluaha Khirawa, P.S.-Sonbarsa, District-Sitamarhi.

(iv) to any relief/s to which the

3. After some argument, learned counsel for the he shall be approaching the Bihar Land Tribunal, Patna for the redressal of the grievance.

4. Learned State counsel has no objection.

5. In that background, the writ petition stands disposed of allowing the petitioner to approach the appropriate authority/court for redressal of the grievance. (Rajiv Roy, J) vinayak/- U
