The Petitioner apprehends his arrest in Minapur P.S. Case No.61 of 2017 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and Sections 30, 38, 41, 45, 47, 48 of Bihar Excise Prohibition Act, 2016, pending in the Court of the Chief Judicial Magistrate, Muzaffarpur.
Petitioner is named in the First Information Report. Allegation against the petitioner is that when the police party went to raid the premises of Horil Prasad on confidential information that business of illicit liquor is going on, this petitioner caused obstruction in the duty of police party. It is also alleged that foreign liquors were recovered from the premises of Horil Prasad and his son-Rajesh Kumar.

Prayer is rejected.
The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off on its own merit preferably on the same day without being prejudiced by this order.
