JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Hajipur Town P.S. Case No. 533 of 2018 dated 04.08.2018 instituted for the offences under Sections 341, 323, 324, 307, 379, 504, 34 of the Indian Penal Code.
The petitioners are said to have assaulted the informant when he refused to pay-up the protection money. The learned counsel for the petitioners has submitted that an absolutely false case has been lodged against the petitioners. In fact, there was some scuffle
Patna High Court Cr.Misc. No.66503 of 2018(2) dt.14-12-2018 2/2 somewhere else in which the informant has received some injuries. Taking advantage of the aforesaid simple injuries on his head, the present case has been lodged implicating the petitioners.
The petitioners do not have any criminal antecedents.
Regard being had to the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender within a period of four weeks from today before the learned Court below, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 533 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
