Petitioner is apprehending arrest in connection with Araria P.S. Case No. 421 of 2018 for the offence under sections 420, 406 and 409 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner was transferred from the concerned branch of the bank on 22.6.2018 and thereafter on 29.6.2018 report was submitted indicating that there was shortage of approximately Rs. 48 lakhs.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He submits that the aforesaid amount was deposited in the account of the bank. The petitioner is still in service in the bank and no proceeding was
Patna High Court Cr.Misc. No.67496 of 2018(3) dt.20-12-2018 2/2 initiated against the petitioner.
Considering the aforesaid, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No. 421 of 2018 subject to the condition that before releasing the petitioner, the petitioner will submit a certificate from the bank about deposit of Rs. 47 laksh and odd in the account of the bank including the condition as laid down under section 438(2) of the Cr.P.C.
