Criminal Miscellaneous No.785 of 2017 Arising Out of PS.Case No. -6 Year- 2016 Thana -BEGUSARAI GRP CASE DistrictBEGUSARAI ======================================================

1. Manikant Kumar S/o Umesh Paswan Resident of Village-Paharchak, Ward No. 27 P.S. Muffasil, District Begusarai .... .... Petitioner/s

Versus

1. The State of Bihar .... .... Opposite Party/s ====================================================== Appearance :

For the Petitioner/s : Mr. Yogesh Chandra Verma For the Opposite Party/s : Mr. Sri Rajeev Nayan ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor.

The application is for grant of bail for the offence under Section 379 of the Indian Penal Code.

It is submitted on behalf of petitioner that though allegation is serious against the petitioner but for that, he remained in custody for about one year and earlier a direction was given to the Sessions Judge for concluding the trial within two months after framing of charge but the trial has not been concluded as yet. Heard learned A.P.P. also. Learned A.P.P. has opposed the prayer for bail and stated that petitioner has got criminal antecedent also.

Having heard both sides. From perusal of

Patna High Court Cr.Misc. No.785 of 2017 (2) dt.12-01-2017 2/2 impugned order itself, it appears that learned Sessions Judge is directed to conclude the trial within two months after framing of charge. As such, I am not inclined to grant bail to the petitioner and for that, his prayer for bail rejected at this stage. However, lower court is directed to expedite the trial and conclude the same within 02 months from today on its own merit considering the detention of the petitioner.

With these observations, this bail application is dismissed.
