The petitioner is accused in connection with Kazimohammadpur P.S. Case No. 86 of 2016, registered under Section 394 of the Indian Penal Code and Section 27 of Arms Act.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. as on the basis of the written report of informant Sandip Kumar, Kazimohammadpur P.S. Case No. 86 of 2016, registered under Section 394 of the Indian Penal Code and Section 27 of Arms Act was instituted and in course of investigation the petitioner was apprehended by the Police in connection with Kazimohammadpur P.S. Case No. 158
Patna High Court Cr.Misc. No.170 of 2017 (2) dt.11-01-2017 2/2 of 2016 and thereafter the Police got recorded his confessional statement showing the involvement of this petitioner in the present case, except that there is nothing against the petitioner while the informant has detailed the physical built up of the culprits, but petitioner has not been put on T.I.P. as yet. Further submission is that petitioner is in custody since 29.07.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-cum-Sub-Judge 1st, Muzaffarpur in connection with Kazimohammadpur P.S. Case No. 86 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
