Petitioner, who is in custody, seeks bail in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 231 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code.

Informant has stated in his written complaint that when he along with his father were returning after selling Oxen with Rs. 67,000/- as sale proceeds, four unknown miscreants came there and snatched Rs. 67,000/- and a mobile bearing SIM No. 7320007111 and fled away. Informant raised alarm then villagers caught hold one of the co-accused Sajad Alam then he disclosed the name of petitioner and two others who had fled away.

No.66975 of 2018(2) dt.22-11-2018 2/2 It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case due to dirty village politics. The name of the petitioner has surfaced on the confessional statement of Sajad Alam who was arrested at the spot. Nothing has been recovered from the possession of the petitioner. He has no criminal antecedent. He is in custody since 25.07.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -Vth, Bettiah (West Champaran) in connection with Chanpatia (Sirisiya O.P.) P.S. Case No. 231 of 2017.
