The petitioner seeks bail in Bihar P.S. Case No. 323/2016, registered for the offences punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The informant along with other police officials raided the house of the petitioner in search of Pintu @ Lobhi Gope. One country-made gun and two packets of live cartridges were recovered from the room of Pintu @ Lobhi Gope. Learned counsel for the petitioner submits that the petitioner is the father of Pintu and he has no manner of concern with the arms and ammunitions recovered from the room of Pintu. Patna High Court Cr.Misc. No.48751 of 2016 (2) dt.23-12-2016 apprehended the petitioner, who is in jail since 31.07.2016. Considering the facts aforesaid and the fact that petitioner is in jail for about five months, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Biharsharif (Nalanda) in connection with Bihar P.S. Case No. 323/2016.
