The petitioner seeks bail in Bihariganj P.S. Case No.23 of 2020 registered under Sections 399, 402, 414 of the Indian Penal Code and under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The police got information that 6-7 criminals assembled at Laxmipur village near bamboo clamp and on such, a raid was conducted. All the seven persons including the petitioner were arrested. On search, from the possession of Md. Niyaz Alam and Shivam Soni arms and ammunitions were recovered. No arms and ammunition was recovered from the possession of the petitioner. It is submitted that similarly situated co-accused namely, Ashish Kumar and Shravan Paswan

Patna High Court CR. MISC. No.21487 of 2020(2) dt.14-08-2020 2/2 have already been enlarged on bail. The petitioner is in custody since 21.01.2020.

Taking into consideration the facts that although the petitioner was arrested along with six other accused persons but no arms and ammunitions were recovered from the possession of the petitioner and petitioner is in jail for about six months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Shri Abhimanyu Kumar, learned J.M. Ist Class, Uda-Kishunganj, District-Madhepura in connection with Bihariganj P.S. Case No.23 of 2020. (Prabhat Kumar Jha, J) Saurabh/- U T
