2. The petitioner seeks regular bail in connection with S.Tr. No.282 of 2024 arising out of Nadi P.S. Case No.24 of 2023 lodged under Sections 302 and 120B of the IPC read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 19.03.2024 passed in Cr. Misc. No.82671 of 2023 with liberty that he may renew his prayer for bail 9 months after framing of charge.

4. Learned counsel for the petitioner further submits that the petitioner's antecedent is clean and he is in custody since 03.09.2023. He further submits that charge has already been framed on 20.06.2024 and more than nine months have

5. Learned counsel for the State opposes the prayer for bail and after observation, more than one year has lapsed. He further submits that all witnesses have been examined except official witness and one independent witness.

In the present facts and circumstances of this case and the submissions made above, it transpires to this Court that no purpose shall be served keeping the petitioner in custody and more than nine months have already lapsed after framing of charge. As such, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of 2nd District and Addl. Sessions Judge, Naugachia, Bhagalpur in connection with S.Tr. No.282 of 2024 arising out of Nadi P.S. Case No.24 of 2023, subject to the following conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
