The sole petitioner, who is in custody in Mehdiganj P.S. Case No.43/16 registered for the offence under Sections 399, 402, 414 of the Indian Penal Code, Sections 47(a), 54 of the Bihar Excise( Amendment) Act,2016 and Sections 20,22 of N.D.P.S. Act, has prayed for grant of bail.

Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner is having clean antecedent. He has also placed the F.I.R. and argued that on perusal of the F.I.R. it is evident that only on suspicion or rather maliciously, the petitioner

Patna High Court Cr.Misc. No.45099 of 2016 (2) dt.15-12-2016 2/2 along with others were arrested.

Learned Addl. Public Prosecutor has opposed the prayer for bail of the petitioner.

Besides hearing learned counsel for the parties, I have also perused the F.I.R. itself and the statement made in paragraph-3 of the petition. Keeping in view the nature of accusation and clean antecedent of the petitioner, let the petitioner, namely, Deepak Kumar be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. Sessions Judge, Patna in connection with Special Case No.23 of 2016 arising out of Mehdiganj P.S. Case No.43/2016. (Rakesh Kumar, J) NKS/- U T
