Petitioner seeks bail in a case registered for the offences punishable under Sections 366A, 379, 323, 504 and 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he kidnapped Nargis @ Dolly, aged about 15 years. The victim-girl in her statement recorded under Section 164 Cr.P.C. has stated that the petitioner took her and after administering some intoxicant, committed rape against her.
Submission of the petitioner is that the petitioner is in custody since 15.08.2016 and the matter appears to be of love-affairs.
Considering the statement of the victim, I am not
Patna High Court Cr.Misc. No.53197 of 2016 (4) dt.30-01-2017 2/2 inclined to enlarge the petitioner on bail in connection with Araria (R.S.) Police Station Case No. 482 of 2016 pending in the court of learned Chief Judicial Magistrate, Araria. Hence, prayer for bail is refused.
The learned court below is directed to expedite the trial.
