JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 14-10-2015 The petitioner apprehends his arrest in relation to Araria P.S. Case No. 516 of 2011, instituted under sections 417, 418, 420 and 120B/34 of the Indian Penal Code.

The petitioner is an employee of Vodafone Mobile Service Provider. In the F.I.R. it is alleged that there were talks between the informant, who is the landlord, and the Vodafone Mobile Service Provider for erecting a Mobile Tower. It is said that the informant had given an advance of Rs.90,000/- in cash, but instead of erecting the Mobile Tower at the informant's land, the Tower was being erected elsewhere, and the money was not being returned.

The truth of the matter is that the site having not been found suitable, another site was found , where the Tower was being erected, and only to pressurize the Company, this case has been instituted. Be that as it may, in the event of arrest or surrender within four weeks in the court below, the above named petitioner shall be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Araria, in connection with Araria P.S. Case No. 516 of 2011, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
