JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 376, 420 and 34 of the Indian Penal Code.
Allegation is that son of the petitioners, on the pretext of marriage, established physical relationship with the daughter of the informant. When the victim conceived, they refused to get their son married with her.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. One Rabindra Mehra, son of the petitioners, is the main culprit and there is no specific allegation against them.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on
Patna High Court Cr.Misc. No.39727 of 2015 (2) dt.30-09-2015 2 / 2 furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura Mahila P.S. Case no. 32 of 2015 (G.R.no. 751 of 2015), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
