2. The petitioner seeks bail in connection with Kalyanpur PS Case No. 165 of 2023 instituted for the offences punishable under Sections 25(1-b)a and 26 of the Arms Act.
3. As per the prosecution case, one country made Katta has been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to local village politics. Nothing incriminating articles has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 27.05.2023.
5. Learned APP opposes the prayer for bail.

From perusal of the FIR and the impugned order of the learned Sessions Judge, Samastipur dated 13.02.2024, it appears that one country made Katta has been recovered from the possession of the petitioner. During investigation not a single witnesses have come forward to support the prosecution case and there is no any independent witness of the seizure list, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur PS Case No. 165 of 2023.
