JUSTICE ASHUTOSH KUMAR ORAL ORDER 17-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Special Case No. 6119 of 2018, arising out of Parsa Bazar P.S. Case No. 196 of 2018, dated 03.07.2018, instituted for the offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The petitioner is the owner of an Innova car, bearing Registration No. DL-7CG-2853, from where 72 liters of liquor has been recovered.

Patna High Court Cr.Misc. No.66701 of 2018(2) dt.17-12-2018 2/2 submitted that he had given the aforesaid vehicle for plying the same to one Md. Irfan, who too was made an accused in this case, but has been granted regular bail. It has further been submitted that the petitioner does not have any criminal antecedents and he did not know that his vehicle would be used for such unauthorized purposes. Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 6119 of 2018, arising out of Parsa Bazar P.S. Case No. 196 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
