The petitioner seeks bail in Bajpatti P. S. Case No. 129 of 2018 instituted for the offence under Section(s) 420 and 406 of the Indian Penal Code.

Learned counsel for petitioner submits that petitioner is son of nephew of informant.

In the written report, it is alleged by the informant that she is blind by birth and her son is mentally retarded. Informant has further alleged that she had a fixed deposit of Rs. 1,35,000/- in Central Bank of India at Madhopur Chaturi branch. The petitioner who is son of nephew of informant anyhow learnt about the fixed deposit of the informant. The petitioner got a joint account opened in the name of her son.

No.20224 of 2019(2) dt.02-04-2019 2/2 Thereafter, got transferred the entire amount in the joint account of informant's son with a view to swindle away the informant's money. Thereafter, petitioner got transferred the aforesaid amount through NEFT in the account of Chandra Narayan and misappropriated the same.

Learned counsel for petitioner submits that all transactions have been done within knowledge of the son of informant.

The petitioner is in custody since 10.12.2018 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Sitamarhi in connection with Bajpatti P. S. Case No. 129 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
