Petitioner, who is in custody, seeks bail in connection with Kasma P.S. Case No. 60 of 2018 registered for the offences punishable under Sections 30(a)/38 of the Bihar Prohibition and Excise Act, 2016.

Informant who is police officer has stated that on 29.07.2018 in course of search 66 liters country made mahua liquor was recovered from Passions Pro motorcycle bearing registration No. BR26F-4174.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is not named in the F.I.R. petitioner is

Patna High Court Cr.Misc. No.67029 of 2018(2) dt.26-11-2018 2/2 in custody since 20.09.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge (Excise), Aurangabad in connection with Kasma P.S. Case No. 60 of 2018.
