JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 143, 144, 147, 148, 149, 188, 290, 291, 294, 341, 323, 307, 353, 120 of the Indian Penal Code and Section 9 of Loudspeaker Act.
As per the FIR, the accused persons including this petitioner made indiscriminate firing inside the premises of Rajendra Library where cultural program was going on. It is submitted on behalf of the petitioner that in the alleged occurrence, no one sustained fire arm injury. Petitioner was one of the organizer and hence he could indulge in such offence. Petitioner claims clean antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VI, Nalanda at Biharsharif in connection with Sare P.S.
