JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 379 of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, he was arrested in connection with Chapra Town P.S. Case No. 205 of 2016 and petitioner and some other accused were confined in Hajat. Para-30 of the case diary goes to show that the informant of the present case as well as one other witness were asked to identify the petitioner and his associate and the informant identified the co-accused, Rahul Kumar. So far as petitioner is concerned, he was not identified by

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Chapra, Saran in connection with Chapra Town P.S. Case No. 201 of 2016.
