The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 366A/34 of the Indian Penal Code.
The accusation is of kidnapping 16 years old daughter of the informant by Rajesh, when the informant went to the house of Rajesh then this petitioner being the mother of Rajesh and her other son informed the daughter that Rajesh kidnapped the daughter of the informant.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against Rajesh. The victim girl is major and aged about 24 years, married with
Patna High Court Cr.Misc. No.41051 of 2015 (2) dt.06-10-2015 2/2 Rajesh and now she has child also.
Considering the thrust of accusation against Rajesh and petitioner being a lady having no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Sanhaula P.S. Case No. 09 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Dinesh Kumar Singh, J) DKS/- U T
