Petitioner is apprehending his arrest in connection with a case initially registered for the offence under Section 307 and other allied Sections of the Penal Code, Section 27 of the Arms Act but after death of the victim Section 302 of the Penal Code was also added. It is submitted on behalf of the petitioner that perusal of the First Information Report would indicate that though petitioner is named therein but no overt act is alleged against him as it is said that petitioner along with Accused No. 4 of the First Information Report used to threaten the deceased with whom

Patna High Court Cr.Misc. No.40418 of 2015 (2) dt.12-10-2015 Accused No. 4 had land dispute.

Let petitioner, named above, surrender in the court below within four weeks from the date of receipt/production of a copy of this order in the court below (A.C.J.M., Patna City) in connection with Fatuha P.S.
