Versus
1. The State of Bihar .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Ravi Kant Kumar, Adv. For the Opposite Party : Mr. Rajesh Kumar, APP 48 ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 03-03-2017 Heard the learned counsel for the petitioner and the State.
This is a petition for grant of anticipatory bail for offence under Sections 354, 354A(2), 354B, 376, 511 and 506 of the Indian Penal Code.
Allegation against the petitioner is that he attempted to commit rape on the informant. The witnesses, who had assembled, on alarm of the informant, have supported the prosecution case before the police that on alarm they reached near the place of occurrence and victim narrated the statement.
Submission of the petitioner is that the petitioner has got no criminal antecedent and has falsely been implicated due to enmity for which a counter case is there.
Considering the nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail.
The prayer for anticipatory bail is rejected. (Birendra Kumar, J) SA/- U √ T √
