The present application has been filed for quashing of the order taking cognizance dated 04.09.2017 passed by learned Additional Sessions Judge-II, Munger in Criminal Revision No.62 of 2017 arising out of G.R. No.2039/2013 in which learned Additional Sessions Judge-II, Munger has declined to interfere with the order dated 20.05.2017 passed by the SDJM, Munger, who has dismissed the discharge petition filed by the petitioner under section-239 of the Code of Criminal Procedure, 1973(For short the Code).

3. It has been informed by the learned District Court

Patna High Court CR. MISC. No.68963 of 2018(2) dt.16-09-2025 2/2 vide letter dated 29.08.2025 that the trial has already progressed and the case is at the stage of evidence in connection with Munger Muffasil P.S. Case No.227 of 2013.

4. In view of the changed stage of trial, the present quashing application stands consigned with liberty to the petitioner to avail appropriate remedy.
