Petitioner seeks bail in Hisua P.S. Case No.218 of 2018 instituted for the offence under Section(s) 363 Indian Penal Code.

In the written report, it is alleged that daughter of the informant, Arbind Kumar, aged about 14 years, is missing since 28.07.2018.

Counsel for the petitioner submits that victim has been recovered. She has given statement under Section 164 Cr.P.C., which is enclosed as Annexure-2. She has stated her age as 17 years and the Court has assessed her age as 18 years. She has stated that she was in love with this petitioner. She had gone voluntarily with him and lived with him till 18th August, 2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Hisua P.S. Case No.218 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
