The petitioners apprehend their arrest in Korha P.S. case No. 201 of 2016 under Section 307 and other Sections of the Indian Penal Code.
The petitioners and others are alleged to have assaulted the informant, Jitendra Prasad Singh, and his family members.
It is submitted that Jitendra Prasad Singh got one injury on his palm on account of fracture of 5th metacarpal bone, nature of the injury opined to be grievous but who was the author of injury has not been given.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.19638 of 2017 (2) dt.06-07-2017 2/2 allegations made against the petitioners and the fact that there is no specific allegation against the petitioner and the occurrence took place on account of land dispute, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Korha P.S. Case No. 201 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
