====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 18-12-2018 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Banka P.S. Case No. 402 of 2018 instituted for the offence under Sections 147, 148, 149, 341, 323, 324 and 307 of the Indian Penal Code. Counsel for the petitioners submit that petitioners are named in the written report, but there is specific allegation against co-accused Sharwan Rajak of assaulting Babu Lal Pasi with Tangari and against Buchhu Rajak of assaulting Bambam Pasi with iron rod. The allegation against petitioner No. 2 is of assaulting Nunu by iron rod causing bleeding injury to him. Petitioners are in custody since 15.9.2018 having clean antecedent.

Patna High Court Cr.Misc. No.72363 of 2018(3) dt.18-12-2018 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P.S. Case No. 402 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioners.
