JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 Protesting against non payment of compensation amount to the family members of one Ranjit Mandal, who was killed in a police firing, allegedly several persons including the petitioner had staged dharna. Upon intervention by the police, the accused persons are said to have assaulted, pelted stones on the police party and a rifle was snatched from a police personnel. On the basis of these allegations Runni Saidpur PS case No. 77 of 2014 was instituted for the offences punishable under sections 147, 148, 149, 323, 325, 307, 332, 333, 427, 379 and 411 of the IPC. The petitioner being an accused in the said case seeks anticipatory bail.

Learned counsel for the petitioner submits that there is no allegation against this petitioner and the rifle allegedly snatched

Patna High Court Cr.Misc. No.47721 of 2014 (2) dt.07-05-2015 2/2 was subsequently recovered by the police party from the possession of one Aash Narayan Mahto.

In view of submissions, as above, the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runni Saidpur PS case No. 77/2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.
