The petitioner apprehends his arrest in connection with Sonbarsa P.S. Case No.01/2021 registered for the offence under Section 7 of Essential Commodities Act. Prosecution case in short is that, the Block Agriculture Officer, Sonbarsa sent the report on 02.01.2021 to the Officerin-charge of Sonbarsa Police Station alleging that the petitioner was caught selling fertilizers without license near M/s Rameshwar Kirana Bhandar and 12 bags of Urea of Kisan Company was seized from his shop which has been handed over to M/s Rameshwar Kirana Bhandar for keeping in safe custody

Patna High Court CR. MISC. No.30420 of 2021(3) dt.21-03-2022 2/3 and requested for lodging prosecution case against the petitioner.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He further submits that no any cogent or tangible material has been found to satisfy his direct or indirect involvement in this prosecution case and there is no signature of the petitioner or his family members on the seizure list. Learned counsel on behalf of the petitioner further submits that petitioner had rented the shop to M/s Rameshwar Kirana Bhandar, from which shop the alleged urea was recovered, who is the license holder. Petitioner has no criminal antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of communication of this order is directed to be released on anticipatory bail on furnishing bail bonds of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sitamarhi Sadar, Sitamarhi in
