JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Jadia P.S. Case No. 67 of 2015 for the offences instituted under Section 366A/34 of the IPC.

The prosecution story, in brief, is that co-accused Subhash Kumar used to tease the minor daughter of the informant in course of visiting to School. A Panchayat was also convened against the act of Subhash Kumar. The informant has further alleged that on 12.06.2015 the said Subhash Kumar with the help of these petitioners kidnapped his minor daughter. It has been submitted on behalf of the petitioners that the

Patna High Court Cr.Misc. No.39743 of 2015 (2) dt.01-10-2015 2/2 petitioners have got no criminal antecedent. It is further submitted that the victim girl has been examined under Section 164 Cr. P.C. where she has stated that she on her own will had left the house with the son of petitioner no. 1 and performed marriage with him at Delhi and for the said reason all the other family members have falsely been implicated in the present case.

On behalf of the State it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Jadia P.S. Case No. 67/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Supaul, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
