Petitioners, who are in custody, seek bail in connection with Special Case No. 7929 of 2018 arising out of Patna Jn. Rail P.S. Case No. 305 of 2018 registered for the offences punishable under Sections 273/34 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation against petitioners are of recovery of total 13.50 liters of Mahua wine from the possession of the petitioners.

It has been submitted on behalf of the petitioners that they are innocent and have committed no offence. They

Seizure list was not made as per provision of law. They have no criminal antecedent. They are in custody since 29.08.2018. Considering the aforesaid fact and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 7929 of 2018 arising out of Patna Jn. Rail P.S. Case No. 305 of 2018.
