The petitioner seeks bail in a case registered for the offence punishable under Sections 302, 328, 120 (B)/34 of the Indian Penal Code.

Submission is that the informant Rajesh Chaudhary has filed written information to the police on 22.05.2017 on the same day his brother Surendra Chaudhary was taken away by the accused persons including the petitioner and dropped there at 12.00 P.M. It is further stated that after some time the deceased was found dead due to some poison as admitted to him. The report of F.S.L. is available in the case diary in which poison and Alkaloids could not be detected. The present case is

Patna High Court CR. MISC. No.23481 of 2019(4) dt.26-06-2019 2/2 filed on the basis of conjecture and surmises and the petitioner has no criminal history. The petitioner is in custody since 08.02.2019.

In the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- III, Hilsa Nalanda in connection with Islampur P.S. Case No. 158 of 2017.
