The petitioner apprehends his arrest in Benipatti P.S. Case No. 64 of 2021, registered for the offences punishable under Sections 363, 366(A) and 364 of the Indian Penal Code. As per the prosecution case, petitioner kidnapped the daughter of informant.

It is submitted that petitioner has been falsely implicated in this case. The victim girl in her statement recorded under Section 164 Cr.P.C has clearly stated that she voluntarily left her house and went along with this petitioner. It is further stated that both of them solemnized marriage and are living as husband and wife. Petitioner claims clean antecedent. In view of the statement of victim girl under Section

No.21612 of 2022(2) dt.05-09-2022 2/2 164 Cr.P.C, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Benipatti, Madhubani in connection with Benipatti P.S. Case No. 64 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
