The petitioner apprehends his arrest in a case registered for the offence under Sections 147, 148, 149, 323, 324, 325, 307, 332, 353, 427 of the Indian Penal Code. As per the prosecution case, the accused persons have created nuisance and caused hindrance in the counting of election.
It is submitted on behalf of petitioner that petitioner has been made accused in this case merely because his motorcycle was parked near the place of occurrence. In fact, petitioner had gone to attend counting in support of his candidate after parking his motorcycle, but during counting, some disturbance was created by unknown miscreants and due to fear, petitioner fled away from the place of occurrence after leaving his motorcycle. Petitioner has not committed any offence and he has got clean antecedent.
Patna High Court CR. MISC. No.27046 of 2023(2) dt.07-07-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - IX, Saran at Chapra in connection with Chapra Muffasil P.S.
