The two petitioners pray for bail in in Banshi P.S. Case No. 41 of 2015 initially registered under section 324, but latter 302 IPC was added after about four months as the informant subsequently died. The allegation is that the accused persons named in the FIR assaulted/attacked the informant with the LathiDanda. He was rushed to a hospital for treatment. It appears that four months after the occurrence the informant died. It is stated that the petitioners are in custody since 07.05.2016 and 1.06.2016 respectively having fair antecedents. Co Accused Ranjeet Yadav, who is similarly named in the FIR, has been released on bail by this Court vide order dated 14.07.2016 (Annexure-2). The charge-sheet has already been submitted in this

Considering the facts and circumstances of the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- each, with two sureties of the like amount each, to the satisfaction of Sri Ashok Raj, Chief Judicial Magistrate, Arwal in Banshi P.S. Case No. 41 of 2015 on condition that one of the bailors of each of the petitioners shall be their own/close family members. In the event of framing of charge, the petitioners shall appear in person each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall have liberty to cancel their bail bonds and secure their arrest in accordance with law.
