The petitioner seeks bail in a case registered under Section 304(B), 201/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner caused death of the daughter of the informant due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.07.2017 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. In course of investigation in paragraph 31 of the case diary, it has come that the deceased was not feeling well. She

Patna High Court CR. MISC. No.30866 of 2019(6) dt.20-09-2019 2/2 was ill and in course of treatment, she has died. Hence, no offence under Section 304(B) of I.P.C. is made out. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Ganga Bridge P.S. case No.54 of 2017.
