JUSTICE BIRENDRA KUMAR ORAL ORDER 27-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 376 and 120B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

Allegation against the petitioner is of sexual exploitation of daughter of the informant on the pretext of marriage. The victim girl has also supported the allegation. Submission of the petitioner is that, in fact, there was marriage negotiation between the two families and on failure of the same the informant has lodged the present case and has lodged another case against the father of the petitioner for

Patna High Court Cr.Misc. No.4028 of 2017 (3) dt.27-04-2017 commission of rape.

Considering the nature of allegation and prima facie material against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for anticipatory bail in connection with Abadpur P.S. Case No.65 of 2012 pending in the court of learned C.J.M., Katihar is refused. (Birendra Kumar, J) Arvind/- U T
