The petitioners pray for anticipatory bail in a case under Sections 304B/34 of the Indian Penal Code.
It is submitted by learned counsel for the petitioners that petitioner No.1 is the sister of mother-in-law of the deceased lady and petitioner No.2 is her son and they have been falsely implicated in this case without any rhyme and reason as even the mother-in-law of the deceased lady and her Bhaisur have been granted anticipatory bail by order dated 30.9.2015 passed in Cr.Misc.No. 28285 of 2015, considering the submission that they are separate in mess and property from the husband of the deceased.
Patna High Court Cr.Misc. No.43228 of 2015 (2) dt.04-11-2015 On a consideration of the facts and circumstances of the case, it is directed that the petitioners, namely, (1) Kusunti Devi and (2) Sudhir Kumar, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Haspura P.S.Case No. 07 of 2015 to the satisfaction of the Sub Divisional Judicial Magistrate, Daudnagar, Aurangabad, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
