JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-08-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the informant is languishing in custody since 20.5.2015 in a case registered under Sections 323,341, 498A and 494/34 of the Indian Penal Code. The basic accusation is of torture and performance of second marriage.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant and the petitioner is ready to keep the complainant as wife with full dignity and honour. The petitioner has not performed second marriage. Statements to that effect has been made in paragraphs 12 and 13 of the petition which read as follows: "That the petitioner is ready to keep her (complainant)

Patna High Court Cr.Misc. No.36974 of 2016 (2) dt.29-08-2016 2/2 as a legal wedded wife with full dignity and honour. " "That the petitioner has never solemnized the second marriage with any another lady."

More over, the investigation has already concluded. Considering the fact that investigation has already concluded and the present stand of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jamui in connection with Jamui Mahila P.S. Case No. 14 of 2016.
